2.1  Finding Thabo is an initiative of The Reach Trust. We developed Finding Thabo as a fun way for practitioners and caregivers to stimulate key parts of children’s brains in fun and interactive ways that develop the building blocks for success in life.

“Finding Thabo” refers to all resources relating to the programme; including written, video, picture and Android app resources.

2.2 The Reach Trust and affiliating partners are responsible for the processing of your personal information when you use Finding Thabo as set out in this Privacy Policy. Our contact details are findingthabo@thereachtrust.org.

3.1. We collect personal information in three ways. If the information is collected directly from your ECD centre, we will notify you before the information is collected. In other cases, we will notify you as soon as feasible after it has been collected.

3.1.1. We directly obtain it from you when your ECD centre participates in the Finding Thabo programme, where the supply of this information is voluntary.

3.1.2 We receive the information which you have agreed to share with us by utilising the Facebook Messenger service or WhatsApp service. 

3.1.3 We collect personal information from you directly when you register an account on the Finding Thabo Teacher’s Android app. 

4. What personal information do we process?

4.1. We process personal information, which may include your name, contact number and ECD centre, but this information will only be shared with a third party outside of our associated partners with your express permission.

4.2 You are responsible for ensuring that the information you provide us is accurate and complete. To ensure the accuracy and completeness of the information, you are also responsible for updating the information supplied.

4.3. Finding Thabo will not be held liable as a result of any inaccuracies or lack of completeness of information.

5.1. We use your information to provide you with Finding Thabo’s services and maintain a user database.

2.1 The Reach Trust, supported by Nedbank, have produce MoveUp to help first-time job seekers to: learn new skills that improve their employability; build a SmartCV (“CV”) that is accessible anywhere, any time; and to apply for entry-level jobs close to them. MoveUp also helps entry-level recruiters and employers to: post entry-level advertisements in simple steps, easily sort and filter through applications online, view all CVs in a streamlined and standardised format, and to shortlist suitable candidates. With MoveUp our aim is to close the skills gap and unlock personal potential through mobile technology that is easy to access and use.

3. How do we collect your information?

3.1 We collect personal information in two ways. First we directly obtain it from you when you use and register for MoveUp or when you have agreed to share information with us by registering your account with third parties to login to MoveUp. And secondly we receive the information which you share with us in creating your CV or by posting a job listing on MoveUp.

3.2 We use cookies to provide you with a better experience. These cookies and Applets allow us to increase your security by storing your session ID and are a way of monitoring single user access. This aggregate, non-personal information is collated and provided to us to assist in analysing the usage of the site.

3.3 Our web servers gather your IP address to assist with the diagnosis of problems or support issues with our services. Information is gathered in aggregate only and cannot be traced to an individual user.

4.1 For job seekers; we process personal information, which includes your name, ID number, date of birth, email address and location, to help you learn new skills, to create and maintain your CV (curriculum vitae), to assess your employability, and to transfer your personal information to possible employers.

4.2 For employers or recruiters; we process personal information which includes your name, email address, company name, industry of work, location, job listing information and the candidates that have applied for your job listings and your use of the information of candidates that have applied for your job listings.

4.3 You are responsible to ensure that the information you provide us is accurate and complete. To ensure the accuracy and completeness of the information, you are also responsible to update the information supplied.

4.4 MoveUp will not be held liable as a result of any inaccuracies or lack of completeness of information.

5.1 We use your information to provide you with MoveUp’s services and to maintain a database of our users.

6.7.2 The CV information of job-seekers will only be used for the online recruitment purposes of MoveUp. This includes sending job seekers CVs to a recruiter and/or employer on MoveUp for the purpose of a job-seekers job application process where such CV data may then be stored by the recruiter or employer independently for future recruitment consideration.

6.7.3 In using MoveUp, recruiters and employers agree to use the service upon the terms set out in this Privacy Policy and in our Terms of Use: www.moveup.mobi/help/terms.

6.7.4 The data of job seekers registering on MoveUp is strictly confidential and may only be stored, or used according to applicable data protection laws, and not any other purpose other than set out herein and the Terms of Use of MoveUp: www.moveup.mobi/help/terms.

6.7.5 Recruiters and employers warrant not to forward or otherwise communicate the personal data of candidates, to respect their confidentiality and to comply with all applicable data protection and privacy rules.

6.7.6 Recruiter and employers are only entitled to contact candidates who submitted an application for concrete vacancies. MoveUp will block the account of any recruiter or employer and withhold access to candidate data in cases of infringements by the recruiter and employer.

The ChildSteps application was developed by The Reach Trust with content provided by educational experts from Botswana, Malawi, Namibia, South Africa, Zambia and Zimbabwe. The project was conceptualised and funded by the Roger Federer Foundation.

SmartStart: Privacy Policy

Definitions

“SmartStart” means a mobile application that aims to provide a new generation of early learning practitioners known as SmartStarters with an easy and efficient way to take quality early learning opportunities to children. The primary goal is to ensure that all children have the right foundations in place to succeed at school and beyond;

“the Application” means any part of the SmartStart Android application, its related mobile sites and/or any software application made available to the User through the Application;

“Application content” includes any material, information, data, software, icons, text, graphics, lay-outs, images, sound clips, advertisements, video clips, trade names, logos, trade-marks, designs and service marks which are displayed on or incorporated in the Application;

“Terms and Conditions of Use” means this agreement;

“User” means any natural person (including where such a natural person is acting is his/her capacity as the representative of a company, close corporation, trust or partnership) accessing, registering for or otherwise making use of any part of the Application; 

Use of the Application

Use of the Application constitutes acceptance of these Terms and Conditions of Use which hereinafter constitute a binding agreement between SmartStart and the User.

Privacy and data retention

SmartStart respects User privacy and will take all reasonable measures to protect the User’s personal information by observing industry best practice and by acting in accordance with all applicable laws.

Portions of the Application may only be available to Users following registration, which requires provision of the following information:

  • full name and surname;

  • email address;

  • mobile number.

SmartStart will not disclose a User’s personal information to any third-party other than as set out below:

  • to its employees and/or third party service providers who require a User’s personal information in order to properly and efficiently provide the services offered by the Application;

  • to law enforcement, government officials, fraud detection agencies or other third parties when SmartStart believes in good faith that the disclosure of personal information is necessary to prevent physical harm or financial loss, to report or support an investigation into suspected illegal activity, or to investigate violations of this agreement;

SmartStart will not retain a User’s personal information for longer than is needed for use of the Application, unless required to do so by law, or unless the User consents to such retention.

SmartStart collects data in order to recognise repeat users, facilitate the ongoing access to and use of the application and allow the application to track usage behaviour and compile aggregate data that will allow SmartStart to improve the functionality of the Application.

Disclaimer and indemnity

Whilst SmartStart takes all reasonable measures to ensure the accuracy of the information provided by the Application, all information including text, images, links, downloads and coding, is provided to the User “as is” and “as available”. SmartStart furthermore makes no representations or warranties, express or implied, including but not limited to warranties as to the correctness or suitability of either the Application or the information contained in it to the User.

SmartStart has no control over third-party content and features which may be accessed through the Application and does not examine or edit such content and features or act as an agent for third-parties accessible through the Application. Accordingly, SmartStart disclaims any liability for loss or damage arising from the use of third-party applications, contents or features.

The User hereby unconditionally indemnifies SmartStart and agrees to hold it free from all loss, damages, claims and/or costs of whatsoever nature, suffered or incurred by SmartStart or instituted against SmartStart as a direct or indirect result of the User’s:

  • use of the Application;

  • failure to comply with any provisions of this agreement, or any other requirements which SmartStart may impose from time to time; and,

  • any unavailability or interruption to access of the Application.

The User specifically indemnifies SmartStart against any and all indirect and/or consequential loss.

Termination and availability

SmartStart will, to the greatest extent possible, endeavour to maintain the availability of the Application, except during scheduled maintenance periods, but is entitled to discontinue access to the Application or any part thereof without notice to the User.

SmartStart may in its sole discretion terminate, suspend, amend and/or modify the Application.

Failure to comply with this agreement may result in suspension and/or termination of the User’s access to the Application, without any prejudice to any claims for damages or otherwise that SmartStart may have against the User.

Security

Whilst SmartStart takes all reasonable measures to ensure the security of the Application, the User hereby indemnifies SmartStart against any and all loss arising from damage caused either by the malicious use of the Application or by destructive data or code that is passed on to the User through the use of the Application.

The following acts in connection with the Application are expressly prohibited:

  • gaining or attempting to gain unauthorised access to any part of the Application;

  • delivering or attempting to deliver any unauthorised or malicious code or content to the Application;

  • any amendment to or attempt to amend any of the content or any other part of the Application by unauthorised persons; and,

  • any other unlawful interference with the proper operation of the Application.

Ownership and copyright

The contents of the application, including any material, information, data, software, icons, text, graphics, lay-outs, images, sound clips, advertisements, video clips, trade names, logos, trade-marks, designs and service marks which are displayed on or incorporated in the Application (“Application Content”) are protected by law, including but not limited to copyright and trade mark law. The Application Content is the property of SmartStart, its affiliates, advertisers and/or sponsors and/or is licensed to SmartStart.

Users do not acquire any right, title or interest in or to the Application or the Application Content by virtue of their use of the Application.

Any use, distribution or reproduction of the Application Content is prohibited unless expressly authorised in terms of this agreement or otherwise provided for in law.

Where any of the Application Content has been licensed to SmartStart or belongs to any third party, your rights of use will also be subject to any terms and conditions which that licensor or third-party imposes from time to time and you agree to comply with such third party terms and conditions.

Applicable law and jurisdiction

This agreement shall be governed by and construed in accordance with the laws of the Republic of South Africa and all disputes, actions and other matters relating thereto will be determined in accordance with South African law, by a South African Court having jurisdiction.

General

This agreement contains the record of the entire agreement between the User and SmartStart as regards use of the Application.

Users may not cede, assign or otherwise transfer any rights they may have under this agreement or which may otherwise have been obtained through the use of the Application.

Should any of the terms and conditions of this agreement be held to be invalid, unlawful or unenforceable, such terms and conditions will be severable from the remaining terms and conditions which will continue to be valid and enforceable.

No party to this agreement shall be bound by any representation, express or implied term, warranty, promise or the like not recorded herein.

No indulgence which any party (“the grantor”) may grant to the other (“the grantee”) shall constitute a waiver of any of the rights of the grantor, who shall not thereby be precluded from exercising any rights against the grantee which may have arisen in the past or which might arise in the future.

No amendment or consensual cancellation of this agreement or any provision or term thereof or of any agreement, bill of exchange or other document issued or executed pursuant to or in terms of this agreement shall be binding unless recorded in a written document signed by a duly authorised representative from both Parties.

No extension of time or waiver or relaxation of any of the provisions or terms of this agreement, bill of exchange or other document issued or executed pursuant to or in terms of this agreement, shall operate as an estoppel against either Party hereto in respect of its right under this agreement, nor shall it operate so as to preclude either of the Parties thereafter from exercising its rights strictly in accordance with this agreement.

Any provision of this agreement which by its context is intended to apply after termination of this agreement shall survive its termination.


Bird seed: Privacy Policy

    1. We (“Bird Seed”, “Early Bird & The Reach Trust”,) respect your privacy.

    2. 1.2 We understand that in today’s interconnected world you may be concerned about what happens with your personal information. We believe in transparency and have implemented this Privacy Policy to inform you about how we collect personal information from you, the type of information we collect, why we collect that information, the circumstances under which that information will be shared with others, the security measures we’ve put in place to protect personal information and the mechanisms we’ve implemented to give you control over your information.

    1. Bird Seed is an initiative of Earlybird Educare@Work. It is intended as a guide to support educare practitioners to implement high-quality learning and development activities on a daily basis with children aged 1 - 5 years.

    2. You are responsible to ensure that the information you provide us is accurate and complete. To ensure the accuracy and completeness of the information, you are also responsible to update the information supplied.

    3. Bird Seed will not be held liable as a result of any inaccuracies or lack of completeness of information.

  4. Why do we collect your information?

    1. We use your information to provide you with Bird Seed’s services and to maintain a database of our users.

    2. Occasionally we and our partners (Reach’s partners, affiliates, agents, funders or contractors) will use your information to improve our services to you and to inform you of our and their services and activities that may be of interest to you.

    3. Finally, we use your information to compile anonymous, aggregated statistics about our users in general.

  5. Will we share your information with anyone else?

    1. We will not share your personal information with anyone without your permission.

    2. From time to time we share anonymous statistics and insights about our users in general with third parties (Reach’s partners, affiliates, agents, funders or contractors) for research purposes.

    3. We make use of certain technical and professional service providers, such as technology and hosting providers, in the course of providing you with our services. They may sometimes be in a position to access your information, but only in terms of a written agreement requiring them to implement appropriate security measures, to maintain the confidentiality of your information, and to only use your information to render services to us or to you.

    4. We may share your information with the authorities, but only when we are compelled to do so by the law.

    5. We will not give your information to any third party on any terms other than set out in this Policy.

  6. How do we protect your information?

    1. We continually review and update our data protection measures to ensure the security, integrity, and confidentiality of your information in accordance with industry best practices. The measures we adopt to ensure the security of your personal information includes technical measures and internal policies to prevent unauthorised access, loss or use of personal information.

    2. Only those employees, partners (Reach’s partners, affiliates, agents, funders or contractors) and service providers that require access to your information to undertake their work relating to our services will be permitted access to your information and only if they have concluded an agreement with us requiring them to implement appropriate security measures and to maintain the confidentiality of your information.

    3. We will inform the Information Regulator if someone unlawfully obtained access to any personal information we process.

  7. How can you control your information?

    1. You can request us to confirm what information we hold about you and to which third parties we’ve supplied your information, by emailing us: support@thereachtrust.org. You may also request that we correct or delete any information and you can object to the continued processing of your information. If you exercise your right to object or if you withdraw your consent and if the circumstances make it reasonable for us to do so, we may suspend our services to you.

    2. If you believe we process your information contrary to this Privacy Policy or in contravention of the law, you may lay a complaint object with the Information Regulator (once it has been established).

  8. Links to other sites

    1. We provide links to Websites outside of Bird Seed, as well as to third party Websites. These linked sites are not under our control, and we cannot accept responsibility for the conduct of companies linked to our website. Before disclosing your personal information on any other website, we advise you to examine the terms and conditions of using that Website and its privacy policy.
